- A REQUEST FOR A GARDEN TOUR and/or ENTRY UPON THE GROUNDS SHALL CONSTITUTE KNOWLEDGE OF AND CONSENT WITH THE TERMS AND CONDITIONS FOR GARDEN TOURS enumerated below.
- GARDEN TOURS ARE BY APPOINTMENT ONLY. No date is confirmed for a Garden Tour unless e-mail confirmation of that date is received from the Webmaster. Garden Tours will be scheduled for non-profit and civic organizations and clubs. No commercial requests for Garden Tours will be considered.
- CANCELLATIONS. Highspire reserves the right to cancel any Garden Tour for any reason, including inclement weather. Contact the webmaster in the event of inclement weather to check the status of your tour. If your group has a confirmed Garden Tour date and will not be attending for any reason, you must notify the webmaster at least 48 hours in advance of your scheduled Garden Tour.
- GARDEN TOURS ARE FREE. Highspire is a private residence, and NO FEE is required for any Garden Tour.
- PHOTOGRAPHY IS PERMITTED during the Garden Tour.
- NO CHILDREN. Adults over the age of eighteen (18) years only - no children, please.
- NO PETS. No pets are permitted on the grounds during Garden Tours.
- ACCESSIBILITY. Highspire is not handicapped accessible.
- NOT RESPONSIBLE FOR ACCIDENTS. While Highspire makes every effort to ensure the safety of all persons, natural or other hazardous conditions may exist consistent with a working garden. Therefore, each individual must exercise due care and caution during Garden Tours. HIGHSPIRE, ITS RELATED ENTITIES, OWNERS, AGENTS AND ASSIGNS ARE NOT RESPONSIBLE FOR ACCIDENTS. By submitting a request for a Garden Tour, you acknowledge on behalf of yourself and your group or organization that you have read , fully understand and agree to the Terms and Conditions, that you are duly authorized to represent and bind your group or organization to the Terms and Conditions, and you, your group or organization, and your individual members fully indemnify, release and hold harmless Highspire, its related entities, owners, agents and assigns for all injury or other loss incurred during a Garden Tour.
- MODIFICATION of these Terms an d Conditions may occur without advance notice and publication of any modifications to this website shall constitute adequate notice.
- CHOICE OF LAW. These Terms and Conditions shall constitute a binding Agreement between your group or organization and Highspire, its related entities, owners, agents and assigns. These Terms and Conditions shall be governed by and interpreted under the substantive law and procedure and conflicts rules of the State of West Virginia and jurisdiction and venue for any dispute arising thereunder shall be the Courts of Morgan County, West Virginia.
